Community Guidelines

The MerchantCircle Community is here to provide you with a friendly environment where you can discuss ideas, give marketing advice, networking advice, discuss how to use MerchantCircle and converse about any other merchant/local business related topic.
 
The MerchantCircle Community is at their best when participants treat their fellow posters with respect and courtesy. Therefore, we ask that you conduct yourself in a civilized manner when participating in both the Community Forums and the MerchantCircle network as a whole.
 
Advertising Products/Competitive Products in the MerchantCircle Forums
 
This category includes advertisement of:

· Any non-beneficial, non-MerchantCircle related businesses, organizations, or websites posted in forums not designated specifically for promoting
 
· Any advertised products that directly compete with similar MerchantCircle products in the forums
 
· Any "spam" that harms the network (either using MerchantCircle features or in the Forums)
 
· Any use of the MerchantCircle network to develop leads for competitive businesses.
 
If a merchant is found to have been spamming or trolling, he/she will:
 
· Be given a temporary or permanent ban from MerchantCircle and/or the MerchantCircle forums, depending upon severity.
 
Inappropriate listing content, as a general policy, will be considered a direct violation of the MerchantCircle Terms os Service (TOS). Specifically, as part of the TOS, all merchants agree NOT to "interfere with or disrupt the Service or servers or networks connected to the Service, or disobey any requirements, procedures, policies or regulations of networks connected to the Service..." MerchantCircle will protect our network from listing pages that could potentially harm transparency with search engines. Therefore, MerchantCircle will, from time-to-time update this listing policy. It is the responsibility of all merchants to stay informed by reviewing the Community Guidelines in MerchantCircle's Help Center.


Fake Listing Pages
 
This category includes:
 
1) Business information that is NOT accurate and/or does NOT represent content of a local business

2) Listing information that is intended to manipulate internet traffic as a form of lead generation.

3) Posting multiple listings directing traffic to one URL.

4) Posting listings with invalid email address or unverified email addresses

If a merchant is found to have been spamming or trolling, he/she will:
 
Be given a temporary or permanent ban from MerchantCircle and/or the MerchantCircle forums, depending upon severity.
Fake listing content, as a general policy, will be considered a direct violation of the MerchantCircle Terms of Service (TOS).

Specifically, as part of the TOS, all merchants “[i]n consideration of use of the Service ... agree to: (a) provide true, accurate, current and complete information about yourself as prompted by the Service's registration form (such information being the "Registration Data") and (b) maintain and promptly update the Registration Data to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, or MerchantCircle has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, MerchantCircle has the right to suspend or terminate your account and refuse any and all current or future use of the Service (or any portion thereof). Additionally, you agree that if you provide false information to obtain access to a MerchantCircle business site that you are not legally entitled to claim, MerchantCircle will be entitled to collect liquidated damages of $1000 per violation or actual damages incurred by MerchantCircle from you.”

Inappropriate Listing Page
 
This category includes the appropriate use and content of the MerchantCircle listing to maintain the health of the network. 
 
The following are the basic guidelines and policies for a MerchantCircle listing page:
 
· MerchantCircle listing must represent a real local or small business. Any content that dose not reflect a local or small business description must be removed.
 
· The business name should be the real business name. IT CANNOT BE a web address (URL) or a general category or geographical description.
 
· The Merchants URL/domain should ONLY be placed on the "Main Website" link from the dashboard. It should only appear once on the listing page.
 
· The text on the "Business Description" should be what a reasonable consumer would expect-- informative content relating to the business. This does not include a list of keywords or locations or zip codes.

· Be given a temporary or permanent ban from MerchantCircle and/or the MerchantCircle forums, depending upon severity.

Spamming and Trolling
 
This category includes:
 
· Excessively communicating the same phrase, similar phrases, or pure gibberish
 
· Creating threads for the sole purpose of causing unrest on the forums
 
· Causing disturbances in forum threads, such as picking fights, making off topic posts that ruin the thread, insulting other posters
 
· Making non-constructive posts
 
· Abusing the Reported Post feature by sending false alarms or nonsensical messages
 
· Abusing the MerchantCircle Network features, such as the Talk to me section, merchant-to-merchant messaging system, and posting advertising reviews.
 
If a merchant is found to have been spamming or trolling, he/she will:
 
· Be given a temporary or permanent ban from MerchantCircle and/or the MerchantCircle forums, depending upon severity.
 
Spamming on the MerchantCircle Network is a direct violation of the Terms of Service agreement.
 

Harassing and Defamatory
 
This category includes both clear and masked language and/or links to websites containing such language or images which:
 
· Insultingly refer to other MerchantCircle users, MerchantCircle employees, or groups of people
 
· Result in ongoing harassment to other MerchantCircle users, MerchantCircle employees, or groups of people
 
If a MerchantCircle user is found to have participated in such actions, he/she will:
 
· Be given a temporary or permanent ban from MerchantCircle and/or the MerchantCircle forums, depending upon severity
 
Harassment takes many forms, and is not necessarily limited to the type of language used, but the intent. Repeatedly targeting a specific MerchantCircle user with harassment can lead to more severe action. The idea behind this is to prevent any one user from consistently being uncomfortable on MerchantCircle and/or the MerchantCircle forums.
 
 
Obscene/Vulgar/Harassing Language
 
This category includes both clear and masked language in posts, signatures, and/or links to MerchantCircle websites containing such language or images which:
 
· Are an inappropriate reference to human anatomy or bodily functions
 
· Are pornographic in nature
 
If a MerchantCircle user is found to have participated in such actions, he/she will:
 
· Be given a temporary or permanent ban from MerchantCircle, depending upon severity
 

Inappropriate language
 
This category includes both clear and masked language and/or links to MerchantCircle websites containing such language or images which:
 
· Are a mildly inappropriate reference to human anatomy or bodily functions
 
· Are otherwise considered objectionable
 
If a MerchantCircle User is found to have participated in such actions, he/she will:
 
· Be given a temporary or permanent ban from MerchantCircle, depending upon severity
